Terms
Terms of Use
Plain-English terms for using this website and purchasing Novenworks services.
About these terms
These Terms of Use apply to the Novenworks website and to general interactions with Novenworks.
Specific client engagements may also be governed by a proposal, statement of work, order form, or service agreement. If a signed agreement conflicts with these general terms, the signed agreement controls for that engagement.
Website use
This website describes Novenworks services and provides educational information for business owners. You may browse the site and share links to publicly available content.
You may not misuse the website, interfere with its operation, attempt unauthorized access to its systems, or reproduce substantial portions of Novenworks content for commercial use without permission.
Purchasing Novenworks services
Novenworks provides business-to-business professional services, including website strategy, design and development, website repair sprints, local search foundations, landing pages and campaign builds, analytics and conversion tracking, and month-to-month website operations.
The exact scope, price, schedule, deliverables, and responsibilities for client work are established before work begins through the applicable proposal, written scope, or service agreement. Website descriptions and published service information are general descriptions and do not create a binding project scope by themselves.
Payments and billing
Payments may be collected through invoices, online checkout, recurring billing, or another payment method agreed with the client. One-time projects may require deposits, milestone payments, or payment in full depending on the engagement.
Recurring services are billed according to the billing cycle stated when the service is purchased or in the applicable agreement. Clients are responsible for providing accurate billing information and paying amounts due under their agreement.
Refunds and cancellations
Refunds and cancellations are governed by the Novenworks Refund & Cancellation Policy and any terms contained in the applicable client agreement. Where a signed agreement contains different terms, the signed agreement controls.
Guarantees
Where Novenworks describes a guarantee — including the Build-It-Right Guarantee and the 30-Day Website Health Window — it applies to the agreed scope of work: pages, links, forms, responsive layouts and conversion paths that Novenworks built, tested and launched. Novenworks corrects defects in that work caused by Novenworks at no additional charge during the stated window.
These guarantees do not cover new features, changes of direction, third-party platform failures, content supplied by the client, or work outside the agreed scope.
Client responsibilities
Clients are responsible for providing information, approvals, account access, assets, feedback, and other materials reasonably needed to perform the agreed work. Delays in client responses, approvals, content, access, or third-party systems may affect timelines.
Clients are responsible for ensuring they have the right to provide Novenworks with any text, images, trademarks, customer data, account access, or other materials supplied for a project.
Third-party services
Novenworks work may involve third-party platforms and services such as hosting providers, domain registrars, analytics platforms, advertising platforms, booking systems, payment processors, email services, software providers, APIs, or other vendors.
Those services are governed by their own terms and may change, experience outages, modify pricing, restrict functionality, or discontinue features outside Novenworks' control. Novenworks is not responsible for failures or policy changes caused solely by third-party providers.
Portfolio and case studies
Novenworks may display client work, demonstration projects, speculative redesigns, design concepts, and case studies. We distinguish between real client engagements and speculative or demonstration work, and label each accordingly.
Client projects are real paid engagements. Demo builds are complete sites we created to demonstrate an approach. Speculative redesigns were built on our own initiative and do not indicate that the company hired Novenworks. Design concepts are explorations. Names and outcomes shown for non-client work do not represent client relationships.
Client case studies may reference products, treatments, services, pricing, memberships, or other offerings provided by the client business. Those offerings are provided by the respective client business, not by Novenworks.
No guaranteed business results
Novenworks does not guarantee search rankings, leads, revenue, customer acquisition, conversion rates, advertising performance, review growth, or other business outcomes.
Marketing and business results depend on many factors outside the control of any single service provider. Case studies describe specific situations and should not be interpreted as promises that another business will achieve the same results.
Educational information
Guides, articles, audits, recommendations, and other educational materials on this website are provided for general informational purposes. They are not legal, tax, accounting, medical, financial, or other regulated professional advice.
Intellectual property
The Novenworks name, branding, website design, original written content, software, graphics, and other original materials on this website are owned by Novenworks unless otherwise stated.
Ownership and licensing of client project deliverables are governed by the applicable client agreement. Our standing policy is that a client's domain, website and core accounts belong to the client. Third-party names, logos, trademarks, and platform references remain the property of their respective owners.
Availability and changes
We may update, change, remove, or add website content and service descriptions as our business evolves. We do not guarantee that every website feature or publicly described service will remain available indefinitely.
